Terms of Service

In order to use our hosting services, please read these Terms carefully. The use of services from Prv.to constitutes agreement to these terms. We are GDPR compliant; by accepting these terms, you also accept our Privacy Policy.

1. Service Provider

All services on Prv.to are provided by:

2. Account Setup & Responsibility

We will activate your account after receiving payment and screening the order for fraud.

• Communication: It is your responsibility to provide and maintain a current email address. This is our primary means of contact for abuse issues or account alerts.
• Security: You are responsible for all actions taken under your account, including the security of scripts/programs installed and the use of secure passwords. We recommend directory permissions be set to 755 or more restrictive.
• Anonymity: Prv.to does not disclose subscriber information to law enforcement or other agencies without a valid Slovak court order.

3. Domain Registration Agreement

By registering or transferring a domain through Prv.to, you agree to the following:

• Registry Terms: You are bound by the terms of the respective TLD Registry (e.g., ICANN, EURid).
• WHOIS Integrity: You must provide accurate contact data. Providing false information may result in immediate account or domain termination.
• Renewal & Fees: Domains must be renewed before expiration to avoid service loss. Once a domain enters the "Redemption Grace Period," additional fees set by the Registry will apply.
• Non-Refundable: Domain-related fees (registration, renewal, transfer) are non-refundable once processed.

4. Shared & WordPress Hosting (Resource Usage)

To ensure stability for all users on shared infrastructure:

• Fair Use: If an account exceeds allocated CPU, RAM, or I/O limits and causes server degradation, Prv.to reserves the right to throttle or suspend the service.
• Managed Updates: For WordPress hosting, Prv.to reserves the right to force-update the WordPress core, themes, or plugins to patch critical security vulnerabilities.
• Prohibited Content (Shared): Shared accounts may not be used for high-frequency bots, mass file storage, or as proxy/VPN entry points.

5. Content & Acceptable Use Policy (AUP)

Services are regulated by Slovak law.

• Defamation: We rely on the Slovak legal system to determine if material is defamatory. We will comply with Slovak court orders to remove or disable access to such material.
• Zero Tolerance: Potential harm to minors (CSAM), support of terrorism, phishing, and "carding" (trafficking stolen financial data) will result in immediate suspension without notice.
• Pharmacy Policy: Services may not facilitate the sale of drugs in violation of applicable laws (jurisdiction of origin and destination). This includes selling prescription drugs without an in-person exam or selling unapproved/counterfeit drugs. Prv.to acts on notices from LegitScript regarding these violations.
• Drug Policy: Facilitating the sale of drugs via Prv.to services is prohibited and voids any money-back guarantees.
• Scanning/Bots: Use of server products for scanning activity or survey bots is prohibited and results in immediate suspension.

6. Zero Tolerance Spam Policy

Sites advertised via SPAM (Spamvertised) may not be hosted on our servers. This includes spam sent via email, fax, IM, or newsgroups. If your account causes our IP space to be blacklisted, we reserve the right to suspend the account and charge a cleanup fee at our sole discretion.

7. Backups and Data Loss

• VPS: Virtual Servers are not backed up unless a specific backup service is ordered.
• Shared/WordPress: Backups are provided as a courtesy only. Prv.to is not responsible for data loss. Users are required to maintain their own off-site backups.

8. Payments, Cancellations, and Refunds

• Billing: Services are billed on a recurring, advanced basis. It is your responsibility to ensure invoices are paid on time.
• Bandwidth: If you exceed your monthly bandwidth allocation, we reserve the right to suspend the account, charge overage fees, or require an upgrade. Unused bandwidth does not carry over.
• Cancellations: Customers may cancel via the client area at any time. Violations of these Terms waive the right to any refund.
• Price Changes: Prv.to reserves the right to change prices and resource allocations at any time.

9. Indemnification & Disclaimer

Customer agrees to defend and hold Prv.to harmless from any claims, losses, or liabilities (including attorney's fees) arising from the customer's use of our services, including copyright infringement or injuries caused by products sold via our servers.

• Disclaimer: Prv.to is not responsible for damages your business may suffer. We disclaim any warranty of merchantability or fitness for a particular purpose.

10. Legal Venue

These Terms are governed by Slovak law. Any disputes shall be brought before the Slovak District Court. Prv.to reserves the right to revise these policies at any time without notice.
